Terms
Quality Driven Transport (the “Owner”) hereby agrees to hire the Vehicle to the Hirer. The Hirer, on their own behalf as well as on behalf of any additional drivers (herein referred to as “Authorized Drivers”), agrees to take the selected vehicle type (the “Vehicle”) subject to the terms and conditions of this Agreement as outlined below.
Terms and Conditions of Hire
General
This is an agreement between Quality Driven Transport and the Hirer. The “Hirer” refers to any person by or on behalf of whom this Agreement is signed. “Authorized Driver” refers to any additional driver who has duly read and signed this Agreement and is subject to its terms and conditions in the same capacity as the Hirer.
The Hirer and Authorized Driver(s) must have held a valid driver’s license for at least 3 years, be over 25 years of age and under 80 years of age, and have had no motor vehicle accidents in the past 3 years for which they were responsible at the date of hire.
A Hirer and/or Authorized Driver(s) over 70 years of age must produce a valid doctor’s certificate dated within 3 months of the hire date.
The Hirer ensures that any Authorized Driver(s) will comply with the terms and conditions of this Agreement.
Where the Hirer is a company, “Authorized Driver(s)” refers to any officer or employee of the company who, by driving the Vehicle, is subject to the same terms and conditions as the Hirer (Company).
The Hirer is strictly prohibited from transferring their obligations under this Agreement.
Return of Vehicle
The Owner must be informed in writing of any change of address of the Hirer during the hire period.
The Hirer will return the Vehicle, including all tires, tools, and accessories, in the same condition as received (ordinary wear and tear excepted), to the specified location on the stipulated return date as declared on the overleaf of this Agreement.
The Hirer and/or any Authorized Driver(s) must keep the Vehicle properly secured at all times.
All vehicles are non-smoking. If the Vehicle is returned with an offensive odor (e.g., smoke) or excessive debris in the interior, or is unreasonably unclean on the exterior, the Hirer may be charged up to BBD $500 (approx. US $250) for the cost of a professional valet service. The Hirer or any Authorized Driver(s) is liable to pay the total fees calculated by the Owner upon return of the Vehicle. These fees and charges will be evidenced by relevant quotes provided by the Owner.
If the Vehicle is returned with less fuel than provided at the date of hire and no fuel option was purchased, the Hirer will be charged for the full amount of replacement fuel and a refueling cost at a rate of 2.5x the cost of the fuel to return the Vehicle to the original fuel level. There will be no refunds on fuel.
If the Vehicle is returned beyond the stipulated date of this Agreement, an hourly fee of US $15 will be charged. If the Hirer returns the Vehicle before the stipulated date, a new rental period (before add-ons and taxes) will be recalculated by dividing the reserved initial weekly rate by 4 and multiplying it by the actual number of days the Vehicle was rented. This newly calculated rate is the amount that the Hirer will be charged.
Property Left in Vehicle
The Hirer will take reasonable precautions to secure any property left in the Vehicle during the hire period (e.g., removing the keys and locking the Vehicle if left unattended). The Owner will not, under any circumstances, be liable for any items placed in or on the Vehicle, or on the premises of the Owner, either before, during, or after the rental term.
Insurance and Excess Waivers (For Loss/Damage)
By accepting the terms and conditions of this Agreement, the Hirer agrees to pay the full deductible associated with the relevant Excess Waiver chosen:
Collision Damage Waiver (CDW): BBD $30/Day, approx. US $15/Day (Deductible of BBD $3,500, approx. US $1,750)
Premium Protection (CDW-PP): BBD $60/Day, approx. US $30/Day (Zero Deductible)
Post-Counter Insurance Selections:
Premium Protection (CDW-TP): BBD $60/Day, approx. US $30/Day
Loss Damage Waiver: BBD $30/Day, approx. US $15/Day
Should the Hirer elect one of these Excess Waiver options, they will be responsible for the maximum insurance deductible associated with the respective Excess Waiver. The Hirer, for themselves and on behalf of any Authorized Driver(s), agrees to comply with and be bound by the terms of the Insurance Policy, which are incorporated by reference into this Agreement, and all other terms of this Agreement.
If the Hirer purchases one of the Excess Waivers, they will provide the Owner with authorization to charge the Hirer’s credit card up to the maximum insurance deductible associated with the Excess Waiver purchased. Alternatively, the Hirer may provide a cash deposit of the maximum insurance deductible associated with the Excess Waiver purchased, which will be refunded in full at the end of the agreed rental period, provided the Vehicle has not been damaged or lost.
The Premium Protection (CDW-PP) covers all damage incurred to the Vehicle. However, the Collision Damage Waiver does not cover the following damages:
Broken glass or interior damage (e.g., cigarette burns, rips, or stains to the upholstery or carpet)
Missing items such as floor mats, spare tires, jacks, radio, lost keys, etc.
Dead batteries
Damage to tires and/or rims
The Hirer accepts full responsibility for the payment of damages/losses exempted from the Collision Damage Waiver.
Lost Keys
In the event that a key is damaged or lost, replacements will cost BBD $1,000 (approx. USD $500) plus vehicle transport cost. Ordinary wear and tear will not qualify as damage to the Vehicle.
Extensions
If the Hirer and/or any Authorized Driver(s) elect to extend this Agreement beyond the rental date stipulated in this document, and Quality Driven Transport consents to this extension, the Hirer and any Authorized Driver(s) agree to be subject to the outlined terms and conditions for the agreed Extension Period and to pay the extension amount using the credit card listed on file.
Accidents and/or Damage(s) to Vehicle
It is a requirement of the Insurance Policy and this Agreement that every accident involving any level of damage to the Vehicle be reported immediately to the Owner and that an Accident Form be completed within 24 hours of the accident. The Hirer or any Authorized Driver(s) will:
Obtain the full names, addresses, license plate numbers, Insurance Company name, and insurance policy type of any other person involved in the accident, as well as full names and brief testimonies from witnesses, where possible.
Contact the Barbados Police Service and not leave the scene of the accident until a full report is made to a member of the Barbados Police Service.
Make no admission of liability.
Deliver to the Owner all summons, writs, and documents produced.
Not aid or abet any claimant but cooperate fully with the Owner and the associated Insurance Company in the investigation and defense of any claim.
The Owner reserves the right to hold an authorization amount of BBD $4,000 (approx. US $2,000) for damages to the Vehicle on the Hirer’s registered credit card for the duration of the rental. Once the Vehicle is returned without damage, this hold will be released.
If the Vehicle is damaged during the Rental Period (including any Extension Period where applicable), and one of the Excess Waiver options was purchased, the Owner reserves the right to increase and retain the authorization hold up to and including the maximum deductible associated with the Excess Waiver. If no Excess Waiver was purchased, the Owner reserves the right to increase and retain the authorization hold to the relevant full cost of damages to that Vehicle type, as outlined in TABLE 1 of this Agreement, as well as any associated third-party damages.
There will be no refunds to the Hirer and/or any Authorized Driver(s) for the loss of the Rental Period owing to an accident, damage, or loss of the Vehicle caused by the Hirer or any Authorized Driver(s).
In the event of damage or loss of the Vehicle, where the responsibility of parties is contentious and must be resolved by the Courts of Barbados, the Hirer agrees to pay in full all consequent and associated Vehicle damage(s) or loss costs, as well as legal, administrative, recovery, repossession fees, or other relevant fees and penalties.
Prohibited Use of Vehicle
The Vehicle must not be driven by:
Any person other than the Hirer or any Authorized Driver(s).
Any person who has given a fictitious or false name, age, and/or address.
Any person who is under the influence of alcohol, barbiturates, any illegal drug or narcotic, or who has abused a prescription drug and/or other controlled substance.
Any person taking prescription drugs or controlled substances that may adversely affect the ability to drive.
Any person using a hand-held communication device or any other device that would result in distraction or deviation from reasonable driving capacity.
The Vehicle must not be used for:
The carriage of passengers and/or property for hire or reward.
Any illegal purpose.
Propelling or towing any other vehicle or trailer.
Racing, pacemaking, reliability trial, speed testing, or driving tuition.
In violation of any Act, Order, or Regulation affecting the use, loading, or condition of the Vehicle, in accordance with the governing laws of Barbados.
Breach of Agreement
Any breach of the aforementioned terms and conditions by the Hirer and/or any Authorized Driver(s) will constitute a “Breach of Agreement” and will result in the loss of the benefit of the Insurance Policy/Excess Waiver if purchased.
The Hirer or any Authorized Driver(s) will indemnify the Owner for all losses and/or damages to the Vehicle or otherwise suffered by the Owner as a result of any such Breach of Agreement.
Where any terms of the Agreement are breached, the Owner reserves the right to terminate the Rental Period with immediate effect. Where the Owner has reasonable cause to believe that the Vehicle has been abused, the Owner reserves the right to terminate this Agreement with immediate effect.
At no time should there be any luggage, surfboards, or any other unauthorized device affixed to the roof of the Vehicle, either on the interior or exterior.
The relevant, legal Vehicle capacity, depending on the seating capacity of the selected Vehicle type (4/5/6/7), must not be exceeded. The Vehicle must not be used as an “Off-road Vehicle.”
Breakdowns and Repairs
The Hirer will immediately inform the Owner of any damage(s) or fault(s) to the Vehicle and will not use the Vehicle while it is in an unroadworthy condition or potentially liable to cause damage to any other vehicle, person, or property. The Owner accepts no responsibility for delays in obtaining relevant vehicle parts due to breakdowns or other relevant circumstances.
In the event of damage(s) occurring during the Rental Period, the Owner reserves the right to charge the Hirer’s credit card for “Loss of Use”, covering rental income lost while the Vehicle undergoes necessary repairs. The Loss of Use Rate is calculated based on the Current Daily Rate of the Vehicle and is subject to 17.5% Value Added Tax. The Owner also reserves the right to charge a 25% Administrative Claim Fee that will be added to the Total Repair Cost of the Vehicle.
Any Authorized Driver(s)
There is an Additional Driver’s Fee of BBD $10 (approx. US $5) + 17.5% VAT per day.
Fines and Expenses
The Hirer or any Authorized Driver(s) accepts full responsibility for all traffic offences or violations of parking regulations involving the Vehicle during the Rental Period (including any Extension Period where applicable), inclusive of all fines and penalties. There will also be a 25% Administrative Claim Fee retained by the Owner on all traffic offence/violation costs involved.
Governing Law
This Agreement and all matters arising from it will be governed and construed in accordance with the laws of Barbados. The parties hereby irrevocably submit to the exclusive jurisdiction of the courts of Barbados.
Severability
If any provision of this Agreement is held to be illegal, invalid, or unenforceable, in whole or in part, the provision will apply with the minimum modifications to make it legal, valid, and enforceable. Any such illegality, invalidity, or unenforceability will not invalidate or render unenforceable the remainder of this Agreement.
Entire Agreement
This Agreement constitutes the whole agreement between the parties regarding the subject matter and supersedes and replaces any prior written or oral agreements, representations, and understandings between them.
